Polla Chilena Takes Regulatory Stand Against Unlicensed Betting Ads in Chile
Chile’s state lottery operator has escalated its enforcement efforts by filing formal complaints against multiple advertising agencies accused of promoting unregulated online betting platforms. The country’s anticipated regulatory framework hasn’t materialised yet, leaving a legal grey zone these agencies are happily exploiting.
Regulatory Enforcement Takes Shape
Polla Chilena de Beneficencia has lodged grievances with Conar, Chile’s advertising ethics authority, targeting agencies including Enelblanco.TV, Ampfy, Draff.tv, and PartnerProd.cl. Their complaints centre on campaigns for operators such as Coolbet, Betano, Jugabet, and Rojabet, which currently lack legal authorisation to operate in Chile.
But the operator’s concerns go deeper than a simple regulatory breach. Polla Chilena argues that these campaigns violate the Chilean Advertising Ethics Code by normalising betting behaviour among younger audiences, downplaying financial risks, and omitting responsible gambling messaging entirely. Take one Coolbet advertisement created by Enelblanco.TV and featuring former Chile national team captain Claudio Bravo. It reportedly included a minor in the spot.
The Normalisation Problem
What really rankles the state operator is the advertising strategy itself. These campaigns position online betting as routine entertainment, seamlessly integrated into everyday activities like watching football. Ampfy’s work for Betano on sports channels exemplifies this approach. Then there’s Draff.tv’s Jugabet ads, which employ gaming visuals specifically designed to appeal to mobile users. PartnerProd.cl’s Rojabet commercials overlay live betting odds during match broadcasts, further embedding wagering into the fabric of sports consumption.
The timing is awkward. Chile’s Congress continues deliberating a formal licensing framework for online gambling, and these campaigns promote illegal services whilst the country attempts to establish legitimate rules. Polla Chilena has positioned itself as the guardian of legal gambling, making earlier enforcement moves including a money laundering claim against payment processors in February.
Jurisdictional Challenges
Here’s where it gets tricky. Unlicensed platforms frequently route transactions through foreign payment processors located beyond Chilean jurisdiction, making direct legal action difficult. No amount of complaints can easily resolve that structural problem. So Polla Chilena’s approach is different: target the advertising ecosystem rather than the operators themselves.
Whether these enforcement actions actually influence the legislative debate? We’ll see. What’s clear is that the cases underscore growing tensions between established gaming operators and emerging digital competitors in a market still negotiating its future rules.
